Terms of Service

Last updated: October 21, 2026

1. Acceptance of Terms

This website is owned and operated by Borrowsy LLC, doing business as Rent Vibe ("Company," "we," "us," or "our"). These Terms of Service are an agreement between you and the Company. These Terms govern your use of the Rent Vibe application and website (collectively, the "Service"). If you do not agree to these Terms, you may not use the Service. Rent Vibe is a peer-to-peer rental marketplace that connects owners ("Listers") with individuals seeking to rent items ("Renters").

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use this Platform. By registering, you confirm that you meet these requirements.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.1 Automated Fraud Monitoring. To protect the community, Rent Vibe automatically logs activity events (including sign-ins, listings, bookings, disputes, incidents, and payment outcomes) and may collect your IP address and a hashed device fingerprint. We use automated risk scoring to assess factors such as new-account activity velocity, repeated payment failures, repeated disputes, and the same device or IP address appearing across multiple accounts. Accounts flagged by these systems may be suspended, restricted, or terminated under Section 16, and suspicious activity may be reported to law enforcement or insurance providers as described in Section 13.7.

3.2 Payment Fraud Detection (Stripe Radar). Every payment processed through the Platform is automatically screened by Stripe Radar, Stripe's AI-powered fraud detection system. Radar evaluates each transaction in real time using machine-learning models trained on billions of payments across the Stripe network, assessing signals such as card and IP address location, transaction velocity, and prior fraud history. Transactions determined to carry the highest risk of fraud are automatically blocked, and elevated-risk transactions are flagged for review. Rent Vibe may also apply custom fraud rules through the Stripe Dashboard to block or review transactions that meet specific risk criteria. Radar operates in addition to — and does not replace — the identity verification requirements in Section 8 or the activity-based risk scoring in Section 3.1.

3.3 Two-Factor Authentication (2FA). Rent Vibe offers optional two-factor authentication (2FA) using TOTP (time-based one-time passwords) compatible with authenticator apps such as Google Authenticator, Authy, and 1Password. When enabled, a verification code from your authenticator app is required in addition to your password each time you log in. You are responsible for keeping your authenticator device and backup codes secure. If you lose access to your authenticator device and backup codes, you may lose access to your account. Rent Vibe may require 2FA for accounts that handle high-value listings or payouts. Enabling 2FA does not guarantee account security and does not relieve you of your responsibility under Section 3 to protect your account credentials.

3.4 Public Profiles and Contact Visibility. Rent Vibe maintains a public member profile for each user, which may display your display name, profile photo, listings, ratings, reviews, trust badges, verification status, and the month you joined, and which may be visible to other users and to visitors who are not signed in. Your email address and phone number are masked by default and are not publicly displayed. Full contact details are shared with another member only after you have completed a rental with that member. Do not place personal contact information, home addresses, or property access codes in public-facing fields such as listing descriptions, public questions and answers, reviews, or profile text.

4. Listings and Rentals

Listers are responsible for providing accurate descriptions, images, and pricing for their items. Listers must have the legal right to rent the items they list. Renters agree to use rented items responsibly and return them in the condition they were received, subject to normal wear and tear. Renters are encouraged to document item condition at pickup using the condition photo feature.

4.1 Maintenance and Service History. Owners are responsible for accurately and honestly updating the maintenance and service history for each listed item. Records must reflect actual services performed, including dates, descriptions, and costs. Falsifying, omitting, or misrepresenting maintenance records to make an item appear better maintained than it is constitutes a material breach of these Terms and may result in listing removal and account suspension. Renters may rely on maintenance records when deciding whether to rent an item, and Rent Vibe is not responsible for verifying the accuracy of owner-submitted records.

4.2 Included Items. Listers are responsible for accurately listing every accessory and item included with a rental (e.g. chargers, cases, cables, remotes) using the "What's Included" feature. Rent Vibe does not verify the completeness of a Lister's included-items list. Rent Vibe will not charge a Renter for, and a Renter will not be liable for, any item that the Lister did not list as included with the rental. Listers who omit included items from their listing do so at their own expense and may not recover the value of unlisted items through damage claims or security deposit holds.

4.3 Multi-Item Cart. Rent Vibe offers a shopping cart feature that allows a Renter to select multiple listings and check out for all of them in a single transaction. Each listing in the cart is booked for its own selected dates and is subject to its own rental agreement, security deposit hold, cancellation policy, and damage terms as if booked individually. The platform fee under Section 5 is applied to each listing separately. A Renter may remove items from the cart before completing checkout. Adding an item to the cart does not reserve the listing or hold the dates; the booking is created only when checkout is completed. If any listing in the cart becomes unavailable (e.g., booked by another Renter or blocked by the Lister) before checkout, that item will be removed from the cart and the Renter will be notified to complete checkout for the remaining items.

4.4 Housing Rentals: Arrival Guide, House Rules, and Check-Out. For housing rentals (apartments, condominiums, houses, and similar residential properties), the following additional terms apply:

  • Arrival guide. The Lister must provide accurate arrival details through the Platform — the check-in method, access instructions or door code, check-in and check-out times, Wi-Fi network and password, parking instructions, and the house rules — and must keep them current. A Renter may rely on these details, and the Lister is responsible for loss arising from inaccurate or outdated access information. Access codes and keys are for the Renter's party only; the Renter must not share them with anyone who is not part of the booking and must promptly report a lost key or access device, the replacement cost of which may be charged to the Renter.
  • House rules and occupancy. The Renter and their guests must follow the house rules disclosed for the stay, including the stated occupancy limit, check-in and check-out times, quiet hours, smoking and pet restrictions, and any prohibition on parties or events. Occupancy must not exceed the limit stated in the listing. The Renter may not sublet the property or use it for any commercial or unlawful purpose. House rules must be disclosed in the listing before the booking is made; rules disclosed for the first time after booking are not enforceable against the Renter.
  • Arrival and check-out condition records. The Lister must record the property's condition at the start of the stay through the arrival guide and check-in record (including photographs and any pre-existing damage), and again at the end of the stay through the check-out record. These records are the baseline used to assess damage under Section 6.4. Damage not documented in the arrival record is presumed to have occurred during the stay.
  • Before-you-leave tasks. The Lister may give the Renter a "before you leave" task list for the stay (for example, taking out the trash, loading the dishwasher, or locking up). These are courtesy check-out instructions. Whether the Renter completes them does not by itself create a charge, and completing them is not evidence that the property was left undamaged. Cleaning and damage assessments are governed by the check-out condition record, not by the task list.
  • Cleaning fees. If the check-out record shows the property was left requiring more than ordinary tidying, the Lister may assess a cleaning fee under the following schedule, which Rent Vibe may update from time to time: $50 for light cleaning and $150 for deep cleaning. Cleaning fees are separate from damage claims and are charged through the direct damage charge process in Section 13.6. Cleaning and ordinary tidying are not covered by the damage waiver under Section 6.5, which excludes normal wear and tear.
  • Turnover checklist. The Platform provides Listers with a turnover checklist to track resetting and cleaning the property between stays. It is a Lister-side tool only and creates no obligation for the Renter.
  • Lister responsibilities and disclosures. The Lister is responsible for the property's condition, safety, and legal compliance, including local short-term rental rules, licensing, occupancy limits, and any homeowners' or condominium association restrictions. The Lister must disclose any security camera or recording device in the listing. Recording devices are prohibited in private areas such as bathrooms and bedrooms, and Rent Vibe may remove any listing that violates this requirement.

4.5 Calendar Accuracy and External Calendar Sync. Listers are responsible for keeping each listing's availability, blocked dates, seasonal pricing, and instant-book settings accurate and up to date. The Platform allows a Lister to import unavailable dates from a third-party calendar, such as an Airbnb or Booking.com iCal/ICS export. Calendar sync is provided as a convenience: it may be delayed, incomplete, or fail, and Rent Vibe does not guarantee that imported dates remain current or that the dates shown on the Platform match a third-party calendar. Listers assume the risk of conflicting or double bookings caused by an inaccurate calendar, and a Lister who cancels a confirmed booking because of a conflicting reservation or an unmaintained calendar is subject to Section 7.1 and, for repeated occurrences, to account suspension under Section 16. Renters should rely on the dates confirmed through the Platform; availability shown on an external calendar is not a guarantee of availability on Rent Vibe.

4.6 Offers and Negotiations. A Renter may propose a price or rental dates by making an offer on a listing. Offers are invitations to negotiate and are not binding contracts on either party. An offer may be accepted or declined by the Lister and expires if it is not accepted. A rental is created only when the offer is accepted and the Renter completes payment through the Platform. Negotiating or completing an accepted offer outside the Platform is prohibited under Section 5.1. Rent Vibe may limit, suspend, or remove access to the offer feature for any user to prevent misuse.

4.7 Rental Agreements and Electronic Signatures. For certain bookings, the Platform generates a rental agreement between the Lister and the Renter, which both parties sign electronically through the Platform. By typing your name and clicking to sign, you consent to the use of electronic signatures and electronic records under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state law, and you agree that your electronic signature has the same legal effect as a handwritten signature. You may withdraw consent to electronic records by contacting Rent Vibe support, but withdrawal may prevent you from completing or maintaining a booking, and you may request a paper copy of any signed agreement by contacting support. By signing, you represent that you are the person named, that you are at least 18 years old, and that you are authorized to bind the party on whose behalf you sign. A signed rental agreement is between the Lister and the Renter only. Rent Vibe is not a party to it, does not provide legal advice, and does not represent either party. The agreement supplements but does not replace these Terms, and as between you and Rent Vibe these Terms control. Failure to sign a required agreement may delay or prevent the booking. Executed agreements may be retained as described in Section 16.1.

4.8 Accurate Listing Data: Replacement Values, Serial Numbers, and Flags. The declared replacement value on a listing must be an honest, accurate estimate of the item's current fair replacement cost, and both parties agree to it as stated in the rental agreement. The declared value determines the security deposit hold and the Renter's maximum liability under Sections 6.3 and 13.5. Inflating a replacement value to recover more than the item is worth is a material breach of these Terms. For serialized items, the Lister must provide the item's correct serial number and photographic evidence; serial numbers may be screened against stolen-property databases, and Rent Vibe may remove or block any listing whose serial number is missing, inaccurate, or flagged. The heavy-equipment flag must be used accurately; using it to avoid the card and verification requirements of Section 6.2.1 is a material breach of these Terms.

5. Payments and Service Fees

Rent Vibe facilitates payments through Stripe. A platform service fee of 10% is applied to each rental transaction. This fee is added to the rental total at checkout. Security deposits, where applicable, take the form of a temporary authorization hold (not a charge) placed on the Renter's card at booking and released automatically 24 hours after the scheduled return date if no valid claim is filed, as detailed in Section 6.

5.1 Prohibition on Off-Platform Payments. All rental payments must be processed through the Rent Vibe platform via Stripe. Listers are strictly prohibited from soliciting or accepting payment outside the platform, including but not limited to directing Renters to use Venmo, Zelle, Cash App, PayPal, wire transfers, cash, cryptocurrency, or any other payment method not provided by Rent Vibe. This requirement protects both parties by ensuring that security deposit holds, damage claims, dispute resolution, and identity verification remain in effect for every rental.

Violations and Penalties. Any Lister who attempts to direct a Renter to pay outside the platform — whether through in-app messages, listing descriptions, or any other communication channel — will have their account automatically suspended for review. Violation of this policy results in:

  • Loss of account privileges — immediate suspension of the ability to list, book, message, or receive payouts through the platform;
  • Forfeiture of platform protections — the Lister forfeits all security deposit holds, damage claim assistance, dispute resolution services, and any and all coverage or protection against theft, vandalism, or damage that may occur during a rental arranged outside the platform; and
  • Potential permanent removal from the platform at the sole discretion of Rent Vibe.

Rent Vibe actively monitors communications for attempts to circumvent platform payments. Listers acknowledge that off-platform transactions are entirely at their own risk and that Rent Vibe bears no responsibility for theft, vandalism, damage, non-payment, or any other loss arising from rentals arranged outside the platform. Renters who are directed to pay outside the platform should report the Lister immediately and decline to complete any off-platform transaction.

5.2 Optional Drop-off / Delivery Service. A Lister may optionally offer drop-off or delivery service for a listing, meaning the Lister will transport and hand over the rented item at the Renter's location instead of requiring the Renter to pick it up. When a Lister enables this service, they choose one of the following fee models:

  • Flat fee. The Lister sets a single delivery price that is charged to the Renter whenever delivery is requested, regardless of distance.
  • Distance-based fee. The Lister provides their zip code, and the delivery fee is automatically calculated based on the straight-line distance between the Lister's zip code and the Renter's delivery zip code, using the following tiers: $5 for 0–10 miles, $10 for 10–25 miles, and $20 for 25+ miles.

The Renter may accept or decline delivery at the time of booking. If accepted, the delivery fee is added to the Renter's total at checkout as a separate line item and is paid directly to the Lister — the platform does not take a commission on the delivery fee. For distance-based delivery, the Renter must provide a valid US zip code; the fee is calculated before payment and displayed on the checkout page. The delivery fee is non-refundable once the item has been delivered. If the Lister fails to deliver the item after the Renter has paid the delivery fee, the Renter is entitled to a full refund of the delivery fee in addition to any other applicable refund under Section 7. The Lister is solely responsible for transporting the item safely and on time; Rent Vibe does not guarantee delivery and is not liable for delays, damage during transit, or failure to deliver.

5.3 Promo Codes and Coupons. Rent Vibe may offer promotional codes or coupons from time to time, redeemed at checkout through Stripe. Promo codes are subject to the following terms: each code may be used once per user unless explicitly stated otherwise; codes are valid only for the stated period and may be modified, revoked, or expired at any time without notice; codes apply only to the rental amount and platform fee and do not reduce the security deposit hold or damage waiver fee; codes have no cash value and are non-transferable; and codes may not be combined with other promo codes or loyalty point redemptions unless explicitly stated. Rent Vibe reserves the right to void any promo code that was obtained, applied, or shared in a fraudulent or unauthorized manner, and to recover the discounted amount from the user's account.

5.4 Buy Now, Pay Later (Klarna). Rent Vibe may offer Klarna or other buy-now-pay-later (BNPL) payment options at checkout, subject to availability and eligibility as determined solely by the BNPL provider. BNPL services are provided by third-party financial institutions under their own terms of service, credit approval, and privacy policies — not by Rent Vibe. By selecting a BNPL option, the Renter authorizes the provider to perform a credit check and agrees to repay the provider according to the provider's installment schedule. If the BNPL provider declines the transaction, the Renter must select an alternative payment method to complete the booking. A failed or missed BNPL payment does not relieve the Renter of their obligation to pay the rental amount; the booking remains active and all cancellation, damage, and liability terms in these Terms continue to apply. Rent Vibe is not a party to any BNPL agreement and is not liable for the provider's lending decisions, interest charges, late fees, or reporting to credit bureaus.

5.5 Split Payments. Rent Vibe offers a split payment feature that allows a Renter to share the cost of a booking with another person. When the Renter initiates a split payment, Rent Vibe generates a secure payment link that is sent to the second payer's email address. The second payer completes their portion of the payment through Stripe Checkout. The booking is not confirmed until the full rental amount has been paid by all parties. If the second payer does not complete their portion within 48 hours, the split payment request expires and the original Renter remains responsible for the full amount. Split payments apply only to the rental amount and platform fee; the security deposit hold (if any) is placed on the original Renter's card. The original Renter is solely responsible for the full booking amount if the second payer fails to pay, and is the party to the rental agreement with the Lister. The second payer's payment is a contribution toward the booking and does not create a separate rental relationship with the Lister. All cancellation, damage, and liability terms in these Terms apply to the original Renter regardless of whether a split payment was used.

5.6 Recurring Rentals. When a Lister enables recurring rentals for a listing, a Renter may book the item on a repeating schedule — the item is rented for a set number of days per occurrence, at a chosen frequency (weekly, bi-weekly, or monthly), for a selected number of occurrences (2–12). The total rental cost is calculated as the per-day price multiplied by the total days across all occurrences, less any recurring discount the Lister has configured. The full recurring total is charged to the Renter at checkout in a single transaction. The booking spans from the first occurrence start date through the last occurrence end date; the Renter is responsible for the item during each scheduled occurrence period. The Lister may offer an optional recurring discount (a percentage off the total) to incentivize recurring bookings. The security deposit hold (if any) covers the entire recurring booking period and is released 24 hours after the last occurrence's scheduled end date, subject to Section 6. The cancellation policy in Section 7 applies to the entire recurring booking as a single reservation — cancelling the recurring booking cancels all remaining occurrences. The Renter may not cancel individual occurrences within a recurring booking. If the Lister cancels, the Renter receives a full refund. Late return fees under Section 7.3 apply per occurrence if the item is not returned by the scheduled end date of any occurrence. All damage, loss, and liability terms in these Terms apply to each occurrence as if it were a separate rental.

5.7 Bundle Packages. A Lister may create a bundle package that groups multiple of their own listings together at a discounted daily rate. When a Renter books a bundle, all items in the bundle are reserved for the same dates in a single transaction. The bundle price is charged at checkout instead of the individual listing prices. The platform fee under Section 5 applies to the bundle total. The security deposit hold for a bundle booking is the sum of the individual deposit holds for each listing in the bundle. The Lister who created the bundle receives the payout for the entire bundle. If any listing in the bundle becomes unavailable (e.g., blocked dates) before checkout, the bundle cannot be booked for those dates. Bundle bookings are subject to the same cancellation, damage, and liability terms as individual bookings. A Lister may not create a bundle with listings owned by another user. Bundle discounts are set by the Lister and may be changed or removed at any time. A bundle must contain at least two listings and the bundle price must be less than the sum of the individual listing prices.

5.8 Payout Scheduling Options (Owners). Rent Vibe offers owners the ability to choose how often they receive payouts for completed rentals. The following payout schedules are available: (a) Immediate — payouts are processed automatically once the rental period ends and no damage incident is open; (b) Weekly — payouts are batched and processed every Monday for all eligible completed rentals; (c) Monthly — payouts are batched and processed on the first day of each month for all eligible completed rentals. The owner's chosen schedule is applied to all completed rentals. Payouts are transferred to the owner's connected Stripe Connect account and are subject to Stripe's payout timing. Rent Vibe is not responsible for delays in Stripe's payout processing. An owner may change their payout schedule at any time in Account Settings; the change takes effect for future payouts. Pending payouts from before the schedule change are processed according to the new schedule. All payouts are subject to the conditions in Section 6 and Section 13.

5.8.1 Instant Cashout (Owners). An owner may request an instant cashout for any eligible completed rental, overriding their normal payout schedule to receive funds faster. A flat fee of $4.00 (the "Instant Cashout Fee") is deducted from the owner's payout amount at the time of transfer. The Instant Cashout Fee applies per booking, not per batch — each booking the owner cashes out instantly is charged the $4.00 fee separately. The fee is non-refundable, even if the transfer is later reversed or disputed. Instant cashout is only available for bookings whose rental period has ended and that have no open damage incident. The owner's remaining payout (after the $4.00 fee) is transferred to their connected Stripe Connect account and is subject to Stripe's transfer timing. Owners who do not wish to pay the fee may wait for their normal payout schedule at no charge. The Instant Cashout Fee is a platform service fee and is retained by Rent Vibe; it is not a Stripe charge.

6. Damage, Loss, and Security Deposit Holds

Rent Vibe is a marketplace, not an insurer, and it does not underwrite or sell insurance. The protections described in this Section — security deposit holds and the Platform's damage waivers — are contractual protections that Rent Vibe makes available to Renters, and they are not insurance policies. Each non-housing rental is secured by either a security deposit hold or a non-refundable damage waiver fee elected by the Renter under Section 6.2.2. For housing rentals, the Renter selects a damage protection option under Section 6.5 — either a $300 security deposit hold or a non-refundable $45 damage waiver fee. Where a security deposit applies, it is collected as a temporary authorization hold, not a charge, and is released if no valid claim is filed. The damage waiver program is administered in partnership with Truvi under Section 6.8, which provides guest-screening and damage-protection services under its own terms.

6.1 Security Deposit Authorization Hold. When a booking includes a security deposit, Rent Vibe places a temporary authorization hold on the Renter's payment card via Stripe at checkout. The hold authorizes the deposit amount but does not charge the card. The hold remains active for the duration of the rental and is released automatically twenty-four (24) hours after the scheduled return date if no damage, loss, or cleaning claim has been filed by the Lister through the Platform. If a valid claim is filed within that 24-hour window, the hold is preserved pending resolution under Section 6.4. If a valid claim is made, the Lister may capture all or part of the held amount up to the deposit ceiling. Captured funds are transferred to the Lister's connected Stripe account. Renters acknowledge that their card issuer may reduce the available balance on the card by the held amount for the duration of the hold.

6.2.1 Card-Type and Identity-Verification Requirements. A credit card is required for the deposit hold — debit and prepaid cards are not accepted — for the following high-risk rentals:

  • Serialized electronics — items in the electronics, gaming, and photography categories, which carry a serial number and are screened against stolen-property registries (e.g., phones, tablets, game consoles, cameras);
  • Motorized vehicles — cars, trucks, motorcycles, watercraft, and other motorized vehicles (which additionally require a valid driver's license under Section 11); and
  • Heavy equipment — construction and farm equipment, or any item the Lister flags as heavy equipment (see "Owner Heavy-Equipment Flag" below).

Identity verification (DIDIT KYC) is required before the booking is confirmed for the same high-risk rentals above (serialized electronics, motorized vehicles, and heavy equipment) and for all housing rentals (Section 6.5.1). Everyday items — including guitars, furniture, sports gear, tools, kitchen equipment, clothing, and similar non-high-risk categories — do not require identity verification, regardless of their declared replacement value. Camping and outdoor gear is also exempt.

All other items — including bicycles, everyday tools, furniture, clothing, sports gear, musical instruments, books, and camping and outdoor equipment — may be booked with either a debit or a credit card. Camping and outdoor gear (tents, sleeping bags, stoves, hiking and climbing gear) remains debit-eligible at any value, even above the $300 threshold. For rentals that do require a credit card, the card-type enforcement rules in the next paragraph apply.

The declared replacement value remains the maximum amount the Lister may recover for damage or loss of the item. Renters remain responsible for the full replacement value of any item that is damaged beyond functionality, lost, or stolen during the rental period. If damages exceed the held amount, the Renter agrees to pay the remaining balance upon invoice via the direct damage charge process described in Section 13.6.

Card-Type Enforcement. The card-type and verification rules in Section 6.2.1 are enforced at checkout. If a credit-card-required rental is paid for with a debit or prepaid card, Rent Vibe will refund the rental payment, cancel the booking, and notify the Renter to rebook using a credit card.

Owner Heavy-Equipment Flag. When listing an item, the owner may flag it as heavy equipment. A flagged item requires a credit card for the deposit hold and applies a $250 heavy-equipment deductible per damage claim, regardless of its category. This ensures equipment such as woodchippers, mini excavators, and other machinery receives heavy-equipment protection even when listed under a non-construction category.

6.2.2 Non-Housing Damage Waiver (Renter-Selected). For non-housing listings, the Renter — not the Lister — may choose between a security deposit hold and a non-refundable damage waiver fee at checkout, before payment. The Lister does not choose or override the Renter's selection. When the Renter selects the damage waiver:

  • Fee. A non-refundable damage waiver fee is charged to the Renter at checkout in place of a security deposit hold. The fee is $15 for items with a declared replacement value under $1,000, and $25 for items with a declared replacement value of $1,000 or more. No authorization hold is placed on the Renter's card.
  • What's covered. Physical damage to the rented item that occurs during the rental period and renders the item broken or unable to function as intended, with a $0 deductible. The waiver fee is pooled into the Platform's damage protection fund to pay damage claims.
  • What's not covered. Normal wear and tear; and lost or stolen items, which may still be charged to the Renter up to the full declared replacement value of the item under Section 6.6 and Section 13.6.

The waiver fee is charged immediately and is not refunded, even if no damage occurs. The Renter's selected option is disclosed at checkout before payment and is recorded on the booking. Regardless of the option selected, the Renter remains responsible for the full declared replacement value of any item that is lost or stolen during the rental period, and for the full cost of any covered damage. If such costs exceed the waiver fee, the Renter agrees to pay the remaining balance upon invoice through the direct damage charge process in Section 13.6.

100% Renter Liability. Renters are 100% liable for any damage, loss, or theft of a rented item that occurs during the rental period, up to the full declared replacement value of the item. The security deposit hold is a pre-authorization and deterrent only; it does not cap or limit the renter's liability. If the cost of damage or loss exceeds the held amount, the renter remains fully responsible for the remaining balance and agrees to pay it upon invoice through the direct damage charge process in Section 13.6.

6.3 Declared Replacement Value. Listers are responsible for providing an accurate replacement value for each listing. The declared value determines the security deposit hold amount and the Renter's maximum liability for damage or loss. Both parties agree to the declared value as stated in the rental agreement.

6.4 Disputed Damage Claims. In the event that a Lister claims damage to a rented item and the Renter denies responsibility, the following resolution process applies:

  • Filing. The Lister must file an incident report through the Platform within 48 hours of the item's return, accompanied by photographic evidence, the pre-rental handover checklist, and (for vehicles) the pre-rental inspection checklist showing the item's baseline condition.
  • Renter Response. The Renter will be notified of the claim and may submit a counter-statement with their own photographic evidence within 72 hours. The Renter may also file a formal dispute through the Platform's dispute resolution feature.
  • Deposit Hold. While a claim is under review, the Lister may place a hold on the Renter's security deposit. The deposit will not be released to either party until the dispute is resolved.
  • Evidence Review. The Platform reviews all submitted evidence, including pre-rental and post-rental photos, handover checklists, mileage and fuel records (for vehicles), property check-in/check-out checklists (for housing), and any communication between the parties. The pre-rental checklist serves as the baseline — damage not documented at handover is presumed to have occurred during the rental period.
  • Resolution. If the evidence supports the Lister's claim, compensation will be deducted from the security deposit hold up to the deposit ceiling (the declared replacement value, or the $300 housing deposit-hold ceiling where the Renter selected the deposit-hold option under Section 6.5). If the evidence is inconclusive or supports the Renter's position, the hold will be released to the Renter in full. The Renter remains liable for the full replacement value if damages exceed the held amount.
  • Escalation. If either party disagrees with the resolution, they may escalate the dispute through the Platform's dispute escalation feature. Escalated disputes undergo additional review, and the Platform's decision is final. Parties retain the right to pursue independent legal action outside the Platform.
  • Bad Faith Claims. Listers who repeatedly file claims that are denied due to insufficient evidence may have their account reviewed and subject to listing suspension. Renters who repeatedly cause damage and deny responsibility may have their account locked per the community standards in Section 10.

6.5 Housing Damage Protection (Renter-Selected). For housing rentals (apartments, condominiums, houses, and similar residential properties), the Renter — not the Lister — selects one of the following damage protection options at checkout, before payment. The Lister does not choose or override the Renter's selection:

  • $300 Security Deposit Hold. A temporary authorization hold of $300 is placed on the Renter's card via Stripe at booking. The hold is released automatically twenty-four (24) hours after the scheduled check-out date if no valid claim is filed, in accordance with Section 6.1. If a valid claim is filed, the Lister may capture all or part of the held amount up to $300.
  • $45 Damage Waiver Fee — Peace of Mind. For peace of mind during your stay, the Renter may instead pay a non-refundable $45 damage waiver fee at checkout. No security deposit hold is placed on the Renter's card. The waiver fee is charged immediately and is not refunded, even if no damage occurs. The waiver program is administered in partnership with Truvi, our damage-protection and guest-screening provider, as described in Section 6.8.
What's covered: Physical property damage that occurs during the stay, including broken furniture, wall damage, damaged appliances, holes punched or kicked into drywall, broken doors, cracked windows, damaged flooring (such as deep hardwood gouges), and broken banisters — with a $0 deductible.
What's not covered: Normal wear and tear; pet damage (excluding damage caused by service animals, as defined by applicable law); and lost or stolen items, which may still be charged up to the full property value.

Both options accept debit or credit cards (prepaid cards are not accepted). The Renter's selected option is disclosed at checkout before payment and is recorded on the booking. Regardless of the option selected, the Renter remains responsible for the full cost of any covered damage that occurs during the stay, and for the full replacement value of any item that is lost or stolen during the rental period. Damage not covered by the waiver (normal wear and tear, pet damage excluding service animals, and lost or stolen items) may still be charged to the Renter up to the property value. If such costs exceed the held amount (or, where the waiver option was selected, the waiver fee), the Renter agrees to pay the remaining balance upon invoice through the direct damage charge process in Section 13.6.

6.5.1 Housing Identity Verification. Regardless of the protection option selected, every housing booking requires the Renter to complete identity verification through DIDIT KYC — including a government-issued photo identification (driver's license, passport, or ID card) and a matching selfie — before the booking is confirmed. Debit and credit cards are accepted for housing rentals; prepaid cards are not. See Section 8 for verification details.

6.6 Qualifying Damage for Replacement. Only damage that renders an item broken or unable to function as intended, or the loss of the item during the rental period, qualifies for automatic replacement up to the declared replacement value. Cosmetic damage, scratches, scuffs, soiling, or other wear that does not impair the item's ability to function does not qualify for automatic full-item replacement. For non-impairing damage, the Lister may seek a reasonable repair or cleaning cost through the incident report and direct damage charge process, but may not charge the Renter for the full replacement value of the item. Whether damage impairs functionality is determined based on the pre-rental and post-rental condition documentation, including photographs and the applicable handover or inspection checklist. Nothing in this section limits a Lister's right to recover the full replacement value where an item is genuinely broken, lost, or stolen during the rental.

6.6.1 Missing Components and Partial Loss. When a Renter returns a rented item missing one or more components or accessories that were listed in the listing's "What's Included" list and verified at handover, the Lister may charge the Renter for the replacement of the missing component(s). The following rules apply:

Whole item vs. single component. If the entire rented item is lost, stolen, or not returned (for example, an entire gaming console), the Renter is charged the full declared replacement value of the item. If only a single component or accessory is missing (for example, a controller or power cable), the Renter is charged only the replacement value of that missing component — not the full replacement value of the entire item — unless the loss of that component renders the remaining item unusable or unsellable, as provided below.

  • Owner must report at the time of return. The Lister must document missing components through the Platform's Return Components Check at the time the item is returned. Missing items not reported at the time of return may not be charged to the Renter through the damage charge process. This requirement ensures both parties have a clear, contemporaneous record of what was and was not returned.
  • Component replacement cost. The Lister may charge the Renter the actual replacement cost of the missing component(s), as determined by current market prices. The Platform provides an AI-powered web search tool that looks up the fair replacement cost for specific components and accessories. If a component is typically only sold as part of a full set and cannot be purchased individually, the Lister may charge the Renter the full declared replacement value of the entire item, since a partial set is often unusable or severely devalued.
  • Full replacement value for unusable sets. Where the loss of a component renders the remaining item unusable or unsellable (for example, a camera body without its lens, a gaming console without its controller, or a power tool without its battery), the Lister may charge the Renter the full declared replacement value of the item, not just the cost of the missing component. The Lister's charge is subject to the replacement value cap in Section 6.3.
  • Renter's responsibility. The Renter is responsible for returning all components and accessories listed in the "What's Included" list. Components not listed by the Lister as included are not the Renter's responsibility, as provided in Section 4.2. The Renter is encouraged to verify the included items list at handover using the component verification feature.

6.7 Sales Tax. Rent Vibe uses Stripe Tax to calculate and collect applicable sales tax on rental transactions at checkout, based on the Renter's location and Rent Vibe's tax registrations. Tax is charged to the Renter on top of the rental price and platform fee and is remitted by Rent Vibe to the appropriate tax authority. Tax does not apply in jurisdictions where Rent Vibe has no tax nexus; in those cases, no sales tax is collected. Renters are responsible for any use-tax obligations that may apply in their own jurisdiction. The exact tax amount is shown on the Stripe Checkout page before payment.

6.8 Truvi Damage Protection and Guest Screening. Rent Vibe's damage waiver program is administered in partnership with Truvi, a third-party damage-protection and guest-screening provider. Truvi screens guests for certain bookings: an owner may enroll a booking in Truvi screening, and the Renter is then directed to a Truvi verification link to complete it. Completing Truvi screening may be a condition of confirming or continuing such a booking, and a Renter who does not complete it may have the booking cancelled, in which case Section 7.1 applies. The damage waiver fees described in Sections 6.2.2 and 6.5 fund the Platform's damage protection program: the portion of each waiver fee attributable to Truvi's protection and screening services is remitted to Truvi, and the remainder is retained by Rent Vibe. Truvi is an independent third party, and it — not Rent Vibe — provides and administers its screening and any protection it extends. Truvi's decisions, and the terms under which it provides those services, are its own, and users who take part in Truvi screening or protection are subject to Truvi's own terms and privacy policy. Rent Vibe does not underwrite insurance, does not guarantee any outcome of Truvi screening or any protection decision, and is not liable for Truvi's acts or omissions. A damage waiver remains a contractual protection offered under this Section and is not an insurance policy. Damage and loss that a waiver does not cover — including normal wear and tear, cleaning, and loss or theft where a claim is declined — remains the Renter's responsibility under Sections 6, 6.6.1, and 13.5 up to the item's declared replacement value. The deposit-hold and damage waiver options described in Sections 6.2.2 and 6.5 are the Platform's own contractual protections and are not insurance.

7. Cancellations, Refunds, and Late Returns

Cancellation and refund terms are determined by the cancellation policy the Lister selects for each listing, which is recorded on the booking at the time of booking. The refund percentage applies to the rental amount charged at checkout (rental plus service fee); the security deposit hold is a separate authorization that is released (voided) upon cancellation regardless of the policy.

7.1 Cancellation by the Lister. If a Lister cancels a confirmed booking for any reason, the Renter receives a full refund of the rental amount charged at checkout, and the security deposit hold is released immediately. Listers are encouraged to keep their calendars accurate to avoid cancelling confirmed bookings.

7.2 Cancellation by the Renter. Renter-initiated cancellations are governed by the policy the Lister selected for the listing. Listers choose one of the following policies for each listing:

  • Flexible (default): Full (100%) refund if the Renter cancels at least 24 hours before the rental start date with advance notice. No refund if cancelled within 24 hours of the start date.
  • Strict: Full (100%) refund if the Renter cancels at least 72 hours (3 days) before the rental start date with advance notice. A 50% refund applies if the Renter cancels within 72 hours but more than 24 hours before the start date. No refund is issued if the Renter cancels within 24 hours of the start date.

If a Lister has not selected a policy, the Flexible policy applies by default. Under the Flexible policy, no refund is issued for cancellations within 24 hours of the start date. Under the Strict policy, a 50% refund is issued for cancellations made within 72 hours but more than 24 hours before the start date, and no refund is issued for cancellations within 24 hours of the start date. Refunds are processed to the Renter's original payment method and typically appear within 5-7 business days. Disputes regarding refunds should be directed to Rent Vibe support.

7.3 Late Return Fees. For non-housing rentals, the Lister may set a custom per-day late return fee when creating or editing a listing. If the Renter returns the item after the scheduled return (end) date, the Lister may record the actual return date through the Platform, and a late fee is calculated and added to the booking:

  • If the Lister has set a custom per-day late fee, that exact amount is charged for each day the item is returned past the due date.
  • If the Lister has not set a custom fee, no late fee applies.

Late return fees do not apply to housing rentals. The Renter is responsible for paying any late fee incurred. Late fees may be collected through the direct damage charge process described in Section 13.6 or deducted from the security deposit hold where one is in place. The per-day late fee in effect at the time of booking is recorded on the booking and applies regardless of later changes the Lister may make to the listing.

7.4 Booking Extensions. A Renter may request an extension of an active booking through the Platform before the scheduled return date. Extensions are priced at the listing's per-day rate in effect at the time of the original booking, applied for each additional day requested. The Renter's existing security deposit hold (or damage waiver, if selected for housing) carries over to the extended period — no new deposit hold is placed. The extended period is subject to the same cancellation policy, damage, and liability terms as the original booking. Extensions are subject to listing availability; if the requested extension dates overlap with another booking or a blocked date, the extension request will be denied. Payment for the extension is processed through Stripe at the time the extension is requested, and the booking's end date is updated upon successful payment. If payment fails, no extension is applied and the original return date remains in effect. Late return fees under Section 7.3 apply if the item is not returned by the extended return date.

8. Identity Verification

Rent Vibe partners with DIDIT, a third-party identity verification provider, to perform know-your-customer (KYC) identity checks on certain renters before a booking is confirmed. When identity verification is required, the Renter is redirected to DIDIT's secure, hosted verification page, where DIDIT collects and processes the Renter's government-issued photo identification and a matching selfie (live biometric facial check). DIDIT — not Rent Vibe — collects, scans, and stores these documents and biometric data in accordance with DIDIT's own terms of service and privacy policy. Rent Vibe receives only the verification result (approved, pending, or declined) and does not store, access, or retain the underlying identification documents or biometric data. By submitting to identity verification, the Renter consents to DIDIT's processing of their personal data as described in DIDIT's privacy policy, and to Rent Vibe's use of the verification result to approve or decline the booking.

8.1 Identity Verification for High-Risk Rentals. Renters booking serialized electronics (electronics, gaming, and photography), motorized vehicles, heavy equipment, or any housing rental must complete identity verification via DIDIT KYC before the booking is confirmed, as described in Sections 6.2.1 and 6.5.1. Camping and outdoor gear is exempt and does not require identity verification. For vehicle rentals, verification requires a valid driver's license; for other high-risk items, a government-issued photo identification (driver's license, passport, or ID card) is accepted. By booking a high-risk item, the renter consents to identity verification as a condition of the rental. Verification is processed by DIDIT, and Rent Vibe does not store the underlying documents. All other rentals — including everyday items such as tools, furniture, musical instruments, sports gear, clothing, and kitchen equipment, regardless of their replacement value — do not require identity verification.

8.2 Housing Verification Through Truvi. For certain housing rentals, Rent Vibe works with Truvi, a third-party verification provider, to help confirm a Renter's employment or income information at the Lister's request or as part of Rent Vibe's screening for higher-value stays. When verification is required, the Renter is directed to a secure Truvi verification link to connect their employment or payroll data. Truvi — not Rent Vibe — collects and processes that data in accordance with Truvi's own terms and privacy policy; Rent Vibe receives only the verification result needed to assess the booking. Completing Truvi verification may be a condition of confirming certain housing bookings. Truvi also provides the guest-screening and damage-protection services described in Section 6.8. Rent Vibe does not guarantee the accuracy or completeness of Truvi's verification or screening results and is not responsible for Truvi's acts or omissions.

8.3 Tiered Verification Framework. We employ a risk-based verification system. Low-risk items (such as standard hand tools or lawnmowers) may only require a basic name and phone database match. High-risk items (such as houses, real estate, vehicles, or high-value electronics) strictly require successful completion of government ID scanning and live biometric facial verification prior to booking approval.

8.4 Right to Refuse Service. We reserve the right to instantly suspend or terminate any user account if our identity verification systems flag fraudulent documentation, duplicate device signatures associated with previously banned accounts, or suspicious device/network footprints.

9. Tax Information (W-9 and Information Reporting)

Listers who earn rental income may be required to submit a W-9 tax form. Rent Vibe collects only the last four digits of your Taxpayer Identification Number (TIN) for verification purposes. You are responsible for reporting rental income in accordance with applicable tax laws.

9.1 Information Reporting (1099). Rent Vibe processes payouts through Stripe, a payment processor that is subject to its own tax-reporting obligations. Where required by the Internal Revenue Service — including where your rental earnings exceed applicable reporting thresholds — Rent Vibe or Stripe may issue one or more information returns, such as Form 1099-K or Form 1099-NEC, reporting the payments you received, and may furnish a copy to the IRS. The full TIN required for reporting is collected and stored by Stripe, not by Rent Vibe. You are responsible for providing an accurate legal name, business name, address, and TIN, and for keeping that information current. If your information is missing, inaccurate, or does not match IRS records, your payouts may be held, backup withholding may apply, or your account may be restricted until the issue is resolved. Listers are responsible for their own income, self-employment, and any local occupancy or hospitality taxes, and for maintaining their own records of rental income and expenses. Rent Vibe does not provide tax advice.

10. Community Standards and Account Standing

To maintain a safe and trustworthy marketplace, user accounts are subject to automatic review based on community feedback. If a user's aggregate community rating falls below 2.0 stars across a minimum of three (3) reviews, the account will be automatically locked. Locked users will be presented with an account status screen upon their next visit to the Platform and will be unable to list, book, or interact until the matter is resolved. Locked users may contact Rent Vibe support to appeal the decision.

Verified Trust Badges. Rent Vibe awards trust badges to users who demonstrate consistent positive feedback from the community. The following badges are displayed on a user's profile when the corresponding criteria are met:

  • Top Owner: Awarded to users who maintain an average rating of 4.5 stars or higher across a minimum of five (5) reviews submitted by renters who have completed bookings with that owner.
  • Trusted Renter: Awarded to users who maintain an average rating of 4.0 stars or higher across a minimum of three (3) reviews submitted by owners from whom the renter has completed bookings.

If a user's average rating subsequently falls below the required threshold, the corresponding badge will be removed automatically. Trust badges are intended to help users make informed decisions and do not constitute a guarantee or warranty by Rent Vibe regarding any user's reliability or the outcome of any rental transaction.

10.1 Reviews Policy. Reviews are intended to provide honest, firsthand feedback about a rental experience. The following rules apply to all reviews on the Platform:

  • Authenticity. Reviews must be based on a genuine, completed rental experience. Users may not review their own listings, review a listing they did not rent, or post a review on behalf of another person.
  • No fake or incentivized reviews. Users may not post, solicit, or pay for fake, fraudulent, or biased reviews. Listers may not offer discounts, refunds, or other incentives in exchange for positive reviews.
  • No retaliation. Users may not post a review primarily to retaliate against another user following a dispute, damage claim, or negative review. Rent Vibe may remove reviews that it determines, in its sole discretion, are retaliatory.
  • Content restrictions. Reviews may not contain personal, identifying, or contact information about another user; hate speech, harassment, or threats; or content that is false, defamatory, or misleading.
  • Removal. Rent Vibe reserves the right to remove any review that violates these rules, that is flagged as fraudulent or abusive, or that is subject to a valid takedown request. Rent Vibe may also suspend or terminate the account of any user who repeatedly violates these review rules.

10.2 Public Questions and Answers. A Renter may post a public question on a listing, and the Lister may post a public answer. Questions and answers are public and may be indexed by search engines. The following rules apply:

  • Only the Lister may answer questions about their own listing.
  • A Lister's answers form part of the listing's representation to Renters, and the Lister is responsible for their accuracy under Sections 4 and 13 of these Terms.
  • Questions and answers must not contain personal or contact information, access codes, solicitations, off-platform payment requests (Section 5.1), promotional content, hate speech, harassment, or anything false or misleading.
  • Rent Vibe may remove any question or answer at its discretion, and may suspend the account of a user who repeatedly violates these rules.

10.3 Reporting Misconduct. Users may report a listing, message, or another user through the Platform's report feature. Reports are reviewed by Rent Vibe and may result in content or listing removal, account restriction, suspension, or termination under Section 16 and — where criminal conduct is suspected — referral to law enforcement or insurers as described in Section 13.7. Knowingly filing a false or abusive report is a breach of these Terms and may itself result in account action. Reporting a concern does not guarantee any particular outcome.

11. Vehicle Rental Addendum

The following terms apply specifically to rentals of vehicles (cars, trucks, motorcycles, watercraft, and other motorized vehicles) listed on the Platform.

11.1 Driver's License Requirement. Renters must possess a valid driver's license and are required to upload a photograph of said license before taking possession of any vehicle. Owners may decline or cancel any booking if the renter's driver's license is not on file or appears invalid.

11.2 Insurance Responsibility. Owners are solely responsible for ensuring that their auto insurance policy covers peer-to-peer rentals, or for obtaining separate commercial rental coverage. Rent Vibe does not provide vehicle insurance and is not a party to any insurance agreement. Owners must acknowledge this responsibility when listing a vehicle. Renters are advised to verify with their own insurance provider whether their policy extends to peer-to-peer rentals.

11.3 Mileage Limits and Fuel Policy. Owners may set a daily mileage limit and a fuel policy for each vehicle listing. Renters agree to abide by the stated mileage limit; excess mileage may result in additional charges at the owner's discretion. The fuel policy (Full-to-Full, Same Level, or Prepaid) must be followed at return. Failure to comply may result in deductions from the security deposit.

11.4 Pre-Rental Inspection Checklist. For all vehicle rentals, a pre-rental inspection checklist must be completed at the time of handover. The checklist documents the fuel level, starting mileage, pre-existing exterior damage, interior condition, and tire condition. Both parties are encouraged to review and acknowledge the checklist together. This checklist serves as the baseline for assessing any damage or discrepancy upon return.

11.5 Handover Instructions. Owners are required to provide handover instructions (pickup location, meeting details, key exchange procedure) through the Platform upon booking confirmation. Renters must follow these instructions and contact the owner via the Platform's messaging system if any issues arise during pickup or return.

11.6 Vehicle Damage and Liability. Renters are fully responsible for any damage to the vehicle that occurs during the rental period, including but not limited to collision damage, interior damage, tire damage, and lost keys. The cost of repairs will be deducted from the security deposit. If repair costs exceed the deposit, the renter agrees to pay the remaining balance upon invoice. Renters are also responsible for any traffic violations, tolls, or parking citations incurred during the rental period.

11.7 Prohibited Uses. Renters agree not to: (a) use the vehicle for any illegal purpose; (b) operate the vehicle under the influence of drugs or alcohol; (c) allow any unauthorized person to drive the vehicle; (d) use the vehicle for racing, off-road driving (unless the vehicle is specifically listed for such use), or any activity that would void the owner's insurance coverage; or (e) smoke or vape in the vehicle.

12. Prohibited Conduct

You agree not to: (a) list illegal or stolen items; (b) use the Platform for fraudulent purposes; (c) harass or harm other users; (d) circumvent the Platform's payment system; or (e) violate any applicable laws or regulations.

12.1 Prohibited and Restricted Items. Users may not list, request, offer, rent, or transact in any item that is unlawful, restricted by law, or forbidden by Rent Vibe policy. The following categories of items are strictly prohibited on the Platform, and this list may be updated at any time:

  • Weapons and explosives. Firearms, ammunition, explosives, fireworks, and other weapons or destructive devices;
  • Unlicensed regulated goods. Any item that requires a license, permit, or certification the user does not hold;
  • Motor vehicles. Motor vehicles may be listed and rented on the Platform, but a vehicle will not be listed unless it has valid, current registration. Owners must provide proof of registration at the time of listing, and Rent Vibe may remove any vehicle listing whose registration is expired, suspended, or invalid;
  • Recalled or counterfeit goods. Recalled, counterfeit, stolen, or unlawfully obtained items;
  • Life-safety equipment. Medical devices, mobility aids, and safety-of-life equipment, including climbing, diving, and rescue gear;
  • Juvenile products. Child car seats, cribs, and other juvenile products subject to safety recalls or expiration dates;
  • Defective or unsafe items. Any item the user knows or should know is defective, unsafe, or unfit for its intended use; and
  • Unlawful items generally. Anything unlawful to rent, possess, or transfer in the jurisdiction where either user is located.

Rent Vibe reserves the right to remove any listing that violates this policy, with or without notice, and to suspend or terminate the account of any user who attempts to list, rent, or transact in a prohibited item.

13. Disclaimers and Limitation of Liability

13.1 No Ownership of Listed Property. Borrowsy LLC, doing business as Rent Vibe, does not own, possess, lease, sublease, or otherwise control any item, vehicle, equipment, real property, or other asset listed on the Platform by Listers. All listed items remain the sole and exclusive property of their respective owners at all times. Rent Vibe is not a bailee, agent, broker, insurer, guarantor, or property manager for any listing, and is not a party to any rental agreement between Listers and Renters.

13.2 Platform Provided "As Is." The Platform is provided on an "as is" and "as available" basis. Rent Vibe disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Rent Vibe does not warrant that the Platform will be uninterrupted, error-free, secure, or that listings are accurate, complete, or legally compliant.

13.3 No Warranty on Listed Items. Rent Vibe does not inspect, verify, certify, or warrant the condition, safety, legality, ownership, or market value of any listed item. Renters acknowledge that they rent items at their own risk and are responsible for inspecting items before use.

13.4 Limitation of Liability. To the maximum extent permitted by law, Rent Vibe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of use, or property damage, arising out of or related to the user's use of the Platform. In no event shall Rent Vibe's total aggregate liability arising from or related to the Platform exceed the total service fees paid by the user to Rent Vibe in the twelve (12) months preceding the claim.

13.5 User-to-User Liability. The foregoing limitation of liability applies solely to Rent Vibe's liability as a platform provider. It shall never apply to liability between users. Renters are fully and personally liable to Listers for any damage, loss, or theft of rented items that occurs during the rental period, up to the full declared replacement value of the item. No cap, limitation, or exclusion of liability — including the platform limitation in Section 13.4 — shall reduce or eliminate a Renter's obligation to compensate a Lister for damage or loss.

13.6 Direct Damage Charges. When a Renter damages or loses a rented item, the Lister may request compensation through the Platform's direct damage charge feature. The Lister submits the damage amount (not to exceed the declared replacement value) and a description of the damage. The Platform generates a secure Stripe payment link that the Renter can use to pay the charge. Upon payment, the funds are transferred to the Lister, less the Platform's service fee. This direct charge mechanism is in addition to, and does not replace, the security deposit hold process described in Section 6. Renters who refuse to pay a legitimate damage charge may have their account locked per Section 10.

13.7 Equipment Theft, Damage, and Legal Disclosure. By renting any asset on this platform, you assume full physical and financial custody of that item until it is safely returned to the rightful owner and the transaction is marked as complete.

Security Deposits and Holds. When a booking includes a security deposit, you authorize Rent Vibe to place a temporary authorization hold — not a charge — on your payment card via Stripe prior to asset handoff. The hold amount and card-type requirements depend on the item and the protection option you select at checkout (see Sections 6.2.1, 6.2.2, and 6.5). For non-housing rentals, you may choose between a security deposit hold or a non-refundable damage waiver fee ($15 for items under $1,000; $25 for items $1,000 or more). For housing rentals, you may choose between a $300 security deposit hold or a non-refundable $45 damage waiver fee. A credit card is required for serialized electronics, motorized vehicles, and heavy equipment; a $250 heavy-equipment deductible applies per damage claim on flagged heavy equipment. The hold is released automatically 24 hours after the scheduled return date if no valid claim is filed. In the event of damage, unreturned items, or late fees, all or part of the held amount may be captured to cover costs. You remain 100% liable for any damage, loss, or theft up to the full declared replacement value of the item; if costs exceed the held amount, you agree to pay the remaining balance via the direct damage charge process in Section 13.6.

Asset Theft and Cooperation with Law Enforcement. If an item is stolen, missing, or deliberately unreturned, it constitutes criminal conversion and theft. In such an event, we will immediately package your full fraud evidence packet—including your scanned government ID, biometric selfie, IP address logs, and device hardware fingerprints—and hand it directly over to our insurance providers and local law enforcement agencies for criminal prosecution.

13.8 Loyalty Program

Rent Vibe may offer a loyalty program ("Rent Vibe Rewards") in which users earn points for completed, paid rentals. Points are awarded at Rent Vibe's sole discretion based on the rental amount and the program rules in effect at the time the rental is marked complete. Points have no cash value and are not transferable, redeemable for cash, or assignable.

Rent Vibe may establish tier levels (e.g., Bronze, Silver, Gold, Platinum) based on lifetime points. The current tier thresholds are: Bronze (0 points), Silver (500 lifetime points, 5% off), Gold (1,500 lifetime points, 10% off), and Platinum (3,000 lifetime points, 15% off). Each tier confers an automatic percentage discount off the entire rental at checkout, applied to the total charged to the guest; the owner's payout is not reduced. Members may redeem any amount of available points at checkout at a rate of 100 points = $1 off the rental, up to the member's balance and the maximum discount permitted for that transaction; members may also choose to redeem zero points and save their balance for a future rental. Points never expire. When a member redeems their full point balance, the balance resets to zero and the member begins earning points anew from subsequent completed rentals. Redeemed points are deducted from the member's balance only after the payment succeeds and are non-refundable. Rent Vibe reserves the right to modify, suspend, or terminate the loyalty program, change point values, tier thresholds, or discount percentages at any time without notice; provided, however, that earned points shall not be expired by Rent Vibe other than upon account termination. Points are forfeited upon account termination. Abuse of the loyalty program — for example, creating bookings solely to earn points and then cancelling, or redeeming points and then disputing the charge — may result in point forfeiture and account suspension under Section 16.

13.9 Environmental Impact Estimates

Rent Vibe may display estimated carbon dioxide (CO₂) savings associated with renting an item instead of purchasing it new. These estimates are approximate, are based on generalized assumptions about manufacturing footprint and product lifespan, and may not reflect the actual environmental impact of any specific item or rental. Carbon impact estimates are provided for informational and educational purposes only and do not constitute a representation, warranty, or guarantee of actual emissions avoided. Rent Vibe's contributions to carbon removal are made through Stripe Climate as described on the Platform.

13.10 AI-Generated Content Disclaimer

The Platform uses artificial intelligence (AI) to assist users with generating listing descriptions, frequently asked questions (FAQs), rental agreement text, and price or replacement-value suggestions. AI-generated content is produced by automated models and may contain errors, omissions, or inaccuracies. Rent Vibe does not review, verify, or warrant the accuracy, completeness, or legality of any AI-generated content. Listers are solely responsible for reviewing and verifying all AI-generated content before publishing it on the Platform, and remain fully responsible for the accuracy of their listings, agreements, and pricing under Sections 4 and 6. Renters should not rely solely on AI-generated content when making rental decisions and are encouraged to inspect items in person before use. Rent Vibe is not liable for any loss or damage arising from reliance on AI-generated content.

13.11 Referral Program Terms

Rent Vibe may operate a referral program through which users can invite others to join the Platform and earn rewards such as a zero-fee period or account credit. The following terms apply:

  • Eligibility. Referral rewards are earned only when the referred user creates a Rent Vibe account using the referrer's unique referral code. Self-referrals, referrals of existing accounts, and referrals generated using fake or duplicate email addresses are void.
  • Reward fulfillment. Referral rewards are granted to the referrer's account after the referred user creates an account and meets any additional conditions stated at the time of the referral offer. Rewards have no cash value and are non-transferable.
  • Expiration. Time-limited rewards (such as the 30-day zero-fee period) expire on the stated date and may not be extended. Account-credit rewards may be subject to a separate expiration date stated at the time of grant.
  • Modification and fraud. Rent Vibe reserves the right to modify, suspend, or terminate the referral program at any time. Users who create fake accounts, share referral codes through unauthorized channels, or otherwise abuse the referral program will forfeit all earned and pending rewards and may have their account suspended under Section 16.

13.12 Intellectual Property and DMCA

User Content License. By posting listings, photos, reviews, or other content on the Platform, you grant Rent Vibe a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, use, display, reproduce, modify, and distribute that content for the purpose of operating, promoting, and improving the Platform. You represent and warrant that you own or have the right to use all content you post and that it does not infringe the intellectual property or privacy rights of any third party.

Platform Content. The Rent Vibe name, logo, design, software, and all content created by Rent Vibe are the exclusive property of Borrowsy LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from Rent Vibe's content without prior written consent.

DMCA / Takedown. If you believe that content on the Platform infringes your copyright, you may submit a takedown notice under the Digital Millennium Copyright Act (DMCA) by contacting Rent Vibe support through the Contact Us page. Your notice must include: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Platform; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized; and (e) a statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf. Rent Vibe will process valid takedown notices and may remove or disable access to the infringing material. Users who repeatedly post infringing content may have their account terminated under Section 16.

13.13 Data Breach Notification

In the event of a data breach affecting users' personal information, Rent Vibe will take reasonable steps to investigate and contain the breach and will notify affected users as required by applicable state data-breach-notification laws. Notification may be delivered by email to the address on file, by in-app message, or by a prominent notice on the Platform. Rent Vibe is not responsible for any breach of data that occurs on the systems of third-party providers (such as Stripe, DIDIT, or Klarna); users should review those providers' breach-notification policies directly. Rent Vibe does not guarantee that any notification will reach users without delay and disclaims liability for any failure or delay in notification to the extent permitted by law.

13.14 Force Majeure

Rent Vibe shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, fires, floods, earthquakes, severe weather, pandemics or epidemics, war, terrorism, civil unrest, government actions, labor disputes, internet or telecommunications outages, power failures, or failures of third-party service providers (including Stripe, DIDIT, and cloud-hosting providers). Rent Vibe will use commercially reasonable efforts to resume performance as soon as practicable after the force majeure event. The obligations and liabilities of users under these Terms — including payment obligations, responsibility for damage or loss, and indemnification — are not excused by force majeure events.

13.15 Communications, Notifications, and Email Alerts

By creating an account, you consent to receive service and transactional communications from Rent Vibe by email and in-app notification relating to your account, listings, bookings, payments, payouts, messages, condition records, damage claims, disputes, reminders, and account security. These communications are part of the Service and cannot be unsubscribed from while you maintain an account.

You may optionally enable additional communications, such as saved-search alerts that email you when new listings match a search you have saved. Optional communications may be turned off at any time in the app, and promotional messages, where offered, include an unsubscribe option. You are responsible for keeping your email address current, and notices sent to the email address on file are deemed delivered to you. Push notifications, where available, require your device's permission and may be disabled in your device settings.

Rent Vibe may monitor, review, and retain messages sent through the Platform for safety, fraud prevention, enforcement, and to detect attempts to circumvent platform payments under Section 5.1. Monitoring is performed on a sampling basis, and Rent Vibe does not guarantee that any particular message will be reviewed. Rent Vibe is not obligated to monitor communications and is not responsible for the content of user messages.

14. Governing Law, Arbitration, and Class Action Waiver

These Terms and any dispute arising out of or related to the Platform shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Borrowsy LLC is a Kentucky limited liability company. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Kentucky, and the parties consent to personal jurisdiction and venue therein.

14.1 Binding Arbitration. Except for disputes that may be taken to small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in Kentucky. The arbitrator's award is final and binding, and judgment on the award may be entered in any court of competent jurisdiction. The parties waive any right to participate in a class-wide or representative arbitration. This arbitration provision does not prevent either party from seeking injunctive or other equitable relief in court to protect intellectual property or prevent unauthorized use of the Platform. A party may opt out of this arbitration provision by sending written notice to Rent Vibe within thirty (30) days of the date the user first accepted these Terms.

14.2 Class Action Waiver. The parties agree that any arbitration or legal proceeding shall be conducted solely on an individual basis and not as a class action or other representative proceeding. The parties expressly waive any right to bring, or participate in, a class action or representative proceeding, and no arbitration may be consolidated with any other arbitration. If a court determines that this class action waiver is unenforceable, then the arbitration provision in Section 14.1 shall be void, and any dispute shall be resolved in the courts of Kentucky as provided in Section 14.

15. Indemnification

Users agree to indemnify, defend, and hold harmless Borrowsy LLC, its officers, members, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) the user's use of the Platform; (b) any rental transaction entered into through the Platform; (c) any content the user posts; (d) any breach of these Terms; or (e) any violation of applicable law by the user.

16. Account Suspension and Termination

Rent Vibe reserves the right to suspend, restrict, or terminate any user account at any time, with or without cause, including for violations of these Terms, fraudulent activity, repeated negative community feedback, or illegal conduct. Upon termination, users lose access to their listings, bookings, and messages. Rent Vibe is not obligated to provide a reason for termination but will process any pending refunds or payouts in accordance with these Terms.

16.1 Termination by You (Account Deletion). You may close and delete your account at any time, without notice or penalty, by opening Account Settings → Delete account and confirming the deletion. When you delete your account, Rent Vibe will permanently remove your listings, bookings, conversations, messages, reviews, saved listings, payout methods, W-9 submissions, notifications, and other content associated with your account, and will deactivate the account. Account deletion is permanent and cannot be undone. You should resolve any open rentals, pending payouts, or active disputes before deleting your account, as Rent Vibe may retain certain records — including completed transaction records, signed rental agreements, tax documents (W-9), and records of open or recently resolved damage claims, disputes, or chargebacks — for as long as required by applicable law, tax regulations, or legitimate business recordkeeping, even after your account is deleted. Deleting your account does not automatically cancel a rental that is in progress or release you from obligations that arose before deletion, including liability for damage, loss, or unpaid charges under these Terms. To exercise this right from a mobile device, open your profile menu, tap Settings, scroll to Account Management, and select Delete account. If you are unable to access your account, you may request deletion by contacting Rent Vibe support through the Platform.

16.2 Effect of Termination. Upon termination of your account for any reason, your right to use the Platform ceases immediately. Any licenses granted by you to Rent Vibe terminate, except that Rent Vibe may retain content as described in Section 16.1. Provisions of these Terms that by their nature should survive termination — including payment obligations, liability for damage or loss, indemnification, and governing law — shall remain in effect.

17. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy and Legal Policy, constitute the entire agreement between Rent Vibe and its users regarding the Platform.

18. Changes to Terms

Rent Vibe reserves the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

19. Contact

If you have questions about these Terms, please contact Rent Vibe support through the Platform's Contact Us page or by email at privacy@gorentvibe.com.

19.1 Complaints and Consumer Rights. If you have a complaint about the Platform, a rental, a charge, or another user, please contact us through the Contact Us page or by email so we can investigate and try to resolve it. Include the booking details, what went wrong, and any supporting information such as photographs or condition records. We will acknowledge your complaint and review the relevant records, messages, and checklists, and we may ask you for additional information. If a complaint is not resolved to your satisfaction, you may ask for it to be escalated for a further review, consistent with Section 6.4. Nothing in these Terms — including the arbitration provision in Section 14.1 and the class action waiver in Section 14.2 — waives any consumer right that cannot lawfully be waived, and nothing prevents you from contacting a government agency. Residents of some jurisdictions may file a complaint with their state attorney general, a state or local consumer protection agency, or another applicable regulator, and you are not required to complain to us first in order to do so. You also retain the right to opt out of arbitration as described in Section 14.1, and our accessibility commitments and complaint process are set out on the Accessibility & Complaints page.
